Every year several thousands of companies, company owners and directors are involved in a in some sort of formal insolvency process
Despite this, the resultant insolvency notices which are sent to creditors to invite their participation in the process are very often ignored. This is often because of the administrative work involved or the perception that recovery rates are to poor to warrant the participation from valuable member of the team that could be productive elsewhere in the business
One of the major changes implemented by the Insolvency Rules 2016 attempted to encourage creditors to be more engaged in the insolvency process. After all, it is they who have lost money so they should have a say as to how any investigations are conducted and what the costs of the insolvency will be.
Creditors of insolvent estates should realise that they have a meaningful role to play in the insolvency process which could significantly improve the prospect of any return to them.
Assets in an insolvency do not only comprise of quantifiable assets. An Insolvency Practitioner has various powers depending on the type of insolvency to investigate any wrongdoing. Information provided by creditors to support these investigations could be key to successfully seeking recompense on their behalf.
